FBOA Indemnity, Assumption of Risk and Participant Declaration
Participation in boating and ocean activities is voluntary and involves inherent risks, including changing weather and sea conditions, movement of the vessel, slips, falls, collision and injury.
Participants confirm that they are fit to participate, will wear and use safety equipment as directed, and will follow all reasonable instructions from the skipper and crew. The skipper has final authority on safety, route, activity and timing.
Participants remain responsible for personal belongings. Alcohol, drugs, unsafe behaviour or refusal to follow safety instructions may result in participation being refused or ended.
Participants accept the inherent risks of the booked activity and indemnify False Bay Ocean Adventures to the extent legally permitted. Nothing in this declaration waives rights or excludes liability that cannot lawfully be excluded under South African law.
A parent or legal guardian must accept for participating minors. Participants authorise reasonable emergency assistance when necessary and confirm that booking information supplied is accurate.
By accepting this declaration during booking, the customer confirms that it has been read and understood for all participants included in the booking.
